What the 2-Year Deadline Actually Means
The statute of limitations is the legal deadline to file a lawsuit, not to finish your case. If two years pass from the date of your accident and no lawsuit has been filed, your claim is almost always gone forever. It doesn't matter how badly you were hurt or how clearly the other party was at fault.
A few important nuances:
- Talking to the insurance company does not stop the clock. Adjusters know the deadline. Some will happily keep "evaluating" your claim right up until it expires.
- Treatment doesn't stop the clock either. Many people wait until they're done with medical care to call a lawyer. If your recovery takes 18 months, you've left your attorney very little runway.
- Different claims have different deadlines. Claims against government entities have strict pre-suit notice requirements that come even earlier. Some older accidents (before March 24, 2023) may still fall under the old four-year rule.
Why Earlier Is Always Better
Even setting the deadline aside, injury cases are built on evidence that disappears fast: surveillance footage gets overwritten, vehicles get repaired or scrapped, witnesses move, and memories fade. The strongest cases are the ones investigated early.
